I ACKNOWLEDGE THAT:

  1. I accept full responsibility on all occasions for deciding whether conditions are such that it is safe for me and / or any guest of mine to sail and that we do so entirely at our own risk and that the Organizers can accept no responsibility for loss or injury however caused, and agree to indemnify the Organizers against any claim by me or any guest of mine.

  2. I accept full responsibility for myself, any of my guests, children or other persons permitted by me to sail or be in any association with the club, on the Organizers premises or premises which are in use by the Organizers at an event and the Organizers can not be expected to exercise any supervision or control over me or them or anyone else.

  3. To prevent any loss, financial or otherwise I am required to take out my own Travel Insurance & health insurance.

  4. The Organizers is/are only able to provide some safety boat facilities limited to those provided by the charter company used for the event during the hours of organized racing/regattas/training and only to those engaged. On all other occasions I accept that no such facilities are provided. It is entirely my responsibility to decide whether I wish to participate.

  5. Refund or transfer to different event/dates for any event/gift voucher (including sailing training courses) will not be issued. XYC may consider refunds/transfer if a replacement is found by me or us. In this case any bank fees/bank commission for processing a refund will be paid by me. Travel or other extra expenses in any form WILL NOT BE REFUNDED.

  6. The Organizers shall not be liable for loss, damage, death or personal injury however caused to the owners / competitors / customers / participants or whoever else, skipper or crew as a result of their taking part in any race, regatta, training or any other event associated with or organized by the company XYC. The Organizers has no knowledge as to the competence or skill of other competitors, crew or skippers. Every skipper warrants the suitability of their boat, chartered or otherwise and crew for the race or races or any other sailing event and competence of the skipper and crew to compete or participate at the level and in the prevailing weather conditions.

  7. In the event of any damage resulting to the boat I am on, where the damage waiver has not been taken out and a refundable deposit paid instead, all of the participants on the boat in question are liable for damage, without exception, regardless of who caused what. The extent of liability is different for different events. I have checked what the liability is for the event I am applying to participate in.

  8. In a case when it becomes impossible to provide booked for the charter boat/boats the Organizers will make all efforts to provide another boat/boats with the similar or better specifications.

  9. I understand that when in the event I take part in there are Third Party Contractors involved (eg. charter company, restaurants, marinas, etc.) then XYC is entitled to go into direct agreements with them and in a case of any such services cancelled/failure to provide/bankruptcy/criminal activities by Third Party Contractors the financial effects cannot be compensated by XYC. However  XYCwill make all efforts to resolve the situation to the client’s benefits.

  10. Competitors are entirely responsible for their own safety, whether afloat or ashore, and nothing reduces this responsibility. It is for competitors to decide whether their boat and its helm and crew are fit to sail in the conditions that they might find. By launching or going to sea competitors confirm their boat is fit for those conditions and that they are competent to sail and compete in them. Nothing done by the Organizers can reduce the responsibility of the owners and/or competitors, nor will it make the Organizers responsible for any loss, damage, death or personal injury, however it may have occurred, as a result of the boat taking part in the racing.

  11. The Organizers may change any part of the event, regatta, race as they see fit at any time.

  12. The Organizers do not accept responsibility for any kind of financial (or otherwise) agreement entered into between you, anyone in your party or anyone else and any other party, without prior written agreement from the organizers. This covers any concyeible agreement or discussion on any subject what-so-ever

  13. In the event of ‘force-majour’, organizers are not financially or otherwise responsible for inability to deliver due to events, actions or omissions of actions, natural disasters, strikes, lockouts, industrial actions, public disorder, revolutions and revolts, blockades, invasions, wars, epidemics and pandemics, travel restrictions, visa rule changes, fires, explosions, sabotage, storms, disasters, vessels aground, fog, acts of government, bankruptcy of Subcontractors or their criminal activities, serious mechanical failures and electrical/water failures or any other extraordinary occasions.

  14. I am over 18.

  15. I understand that: at all times I am fully aware of the risks associated with sailing and am fully responsible for my decision to go sailing in accordance with these terms and conditions.

  16. I understand that if my behaviour is considered inappropriate by the organizers, I understand that I will be removed from the boat and event, with any and all associated cost incurred attributed to me. No refund shall be issued under any circumstances.

  17. I understand that the Organizers keeps participation details on a computer for administrative purposes.

  18. I understand that if the event is cancelled by XVC, a full refund will be offered to you (excluding any additional expenses encurred by you), or an alternative event offered.

  19. These terms and conditions shall be governed by and construed in accordance with _______law.

  20. Any disputes relating to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of___________..
